Restrictions on Bail
The Restriction on Bail (RoB) provision provides for a restriction on court bail for adult defendants who have tested positive for a specified Class A drug and whose offence is a drug offence or believed by the court to be related to, or motivated by, drug misuse.
Since March 2006, this provision has been available to all local justice areas across England. This means that any adult who appears before a court in England could be eligible for the provision if they have previously tested positive in police custody, in relation to the offence, for a specified Class A drug. Restriction on Bail acts as an incentive for defendants who have tested positive for a specified Class A drug to address their drug misuse and engage in any proposed treatment and/or other support, or face an increased risk of being refused bail. It targets those defendants whose offending is related to their use of specified Class A drugs (heroin, crack/cocaine) - shown to be those most closely linked to acquisitive crime - with the aim of reducing offending on bail.
